Opting for Litigation
The majority of Amril’s cases have not required the legal route. We only consider litigation when all other avenues of debt recovery have been exhausted, and where we feel it is both necessary and appropriate. The whole process will be outlined to you before you take this route, including all potential charges. We are skilled in supporting your preparation for the court case, ensuring you have all the relevant documentation and details clearly presented. Consideration must be given to the cost of litigation versus the likelihood of the plaintive meeting the judgement. Additionally, opting for the litigation route almost always results in a lost customer.
The Late Payment of Commercial Debt Interest Act 1998.
This legislation states that debtors will be forced to pay interest and reimburse the reasonable recovery costs of the debtor, if they do not pay for goods on time – 60 days for business and 30 days for public authorities.
You may exercise your interest rights from the date the debt becomes overdue and up to six years from the due date. The rate of this interest is the Bank of England base rate plus 8% per annum. To avoid complexities, the regulations define a ‘reference rate’.

In circumstances where the debtor fails to honour the court judgement, Amril fully understands the procedures regarding enforcement. We can assist you in deciding on the most effective course of action to take, and guide you through the necessary processes.
Where the debt is over £600, we can apply for a Warrant of Execution. This action will send the court bailiffs to your debtor’s premises to either receive settlement, or to remove goods to the value of the debt.
